COPYRIGHT POLICY

YouPlus Media, LLC and its affiliates and subsidiaries (collectively, “You+Media” or “Company”) respects the intellectual property of others, and we ask our users to do the same. You+Media has no responsibility for content on other web sites that you may find or access when using Company’s products or services. Material available on or through other web sites may be protected by copyright and the intellectual property laws of the United States and/or other countries. The terms of use or service and/or copyright policies of those web sites, and not the You+Media Terms of Service, govern your use of that material.

It is You+Media’s policy, in its sole discretion, to remove content, disable and/or terminate the accounts of users who violate this policy, infringe or are accused of infringing the copyrights or other intellectual property rights of You+Media and/or others. You+Media requires all users and members to affirm that they hold the copyright or have appropriate permission for the content that they upload and/or post on You+Media web sites.

General Copyright Information

The Digital Millennium Copyright Act (DMCA) Title II, Online Copyright Infringement Liability Limitation Act (OCILLA), creates a safe harbor for online service providers (OSPs, including ISPs), such as You+Media, against copyright liability if they adhere to and qualify for certain prescribed safe harbor guidelines and promptly block access to allegedly infringing material (or remove such material from their systems) if they receive a notification claiming infringement from a copyright holder or the copyright holder's agent. OCILLA also includes a counter-notification provision that offers OSPs a safe harbor from liability to their users, if the notice from such users claiming that the material in question is not, in fact, infringing. OCILLA also provides for subpoenas to OSPs to provide their users' identity.

Copyright Infringement Prevention

You+Media makes it clear in our Terms of Service and at the time of the upload of any content that a user must own the copyright to the content they post or have permission from the copyright holder. We take copyright issues seriously and encourage copyright holders to contact us if they have any objections to specific videos, and we will cooperate with them to take down any infringing content promptly. Repeat and flagrant offenders of the Terms of Service are addressed appropriately.

Notification of Claimed Copyright Infringement

If you believe that someone else has uploaded your copyrighted content without your permission, please submit the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of the written Notice containing the above information:

  1. You+Media will remove or disable access to the material that is alleged to be infringing
  2. You+Media will forward the Notice to the alleged infringer;
  3. You+Media will take commercially reasonable steps to promptly notify the alleged infringer that it has removed or disabled access to the material.

Counter Notice

If you believe that you have been falsely accused of copyright infringement, you may file a Counter Notice with You+Media. The Counter Notice must include the following:

  1. A physical or electronic signature of the alleged infringer.
  2. Identification of the material that has been removed or to which access has been disabled and the location before removal.
  3. A statement under penalty of perjury that the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Their name, address, telephone number and a statement that they consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that they will accept service of process from the person who provided notification or an agent of such person.

Upon receipt of a Counter Notice containing the above information:

  1. You+Media will promptly provide the complaining party with a copy of the Counter Notice;
  2. You+Media will inform the complaining party that it will replace the removed material or cease disabling access to it within ten (10) business days;
  3. You+Media will replace the removed material or cease disabling access to the material within ten (10) to fourteen (14) business days following receipt of the Counter Notice, provided You+Media’s designated DMCA Agent has not received notice from the complaining party that an action has been filed seeking a court order to restrain Subscriber from engaging in infringing activity relating to the material on You+Media network or system, and provided further that the disputed material does not violate any of You+Media’s other Terms of Service.

Please note that, due to security concerns, attachments cannot be accepted. Accordingly, any notification of infringement submitted electronically with an attachment will not be received or processed.

Please note that any person who knowingly materially misrepresents that material or activity is infringing and may be subject to liability for damages; and that the information provided in this legal notice may be forwarded to the person who provided the allegedly infringing content.
